In respect of the draft federal law IUE developed a concept of how to facilitate decision-making procedures at general meetings of owners of dwelling units in apartment buildings in Russia

One of the current priorities of the state housing policy consists in encouraging the owners of dwelling units in apartment buildings to assume active and self-sufficient attitude. This is envisaged in the Strategy for Development of Housing and Utility Sector of the Russian Federation for the period till 2020.

According to IUE the task necessitates that decision-making procedures at general meeting of owners of dwelling units in apartment buildings be drastically streamlined in one of the following ways:

a) to simplify the procedures for convocation and holding of a general meetings of owners of dwelling units, and for recording the results of the general meeting;

b) to reduce the quorum for repeat general meetings and shift from the approach “those who failed to attend the general meeting or abstained from voting, would be considered as votes “against” whereby any person unable to participate at a general meeting prevents a quorum from being formed and impedes a decision-making on the issues included on the agenda, to the approach “those who failed to attend the general meeting shall not impede the adoption of the proposed solution”;

c) to reduce the number of votes for decision-making on the issues, which require a qualified majority of votes, down to a simple majority of votes from the total votes of all the owners of dwelling units;

d) to introduce a procedure for holding a general meeting in the form of a conference for making management-related decisions with regard to large apartment buildings.
